Please read the following carefully before booking a model.
As required by Department of Employment Regulations the My Kids Agency booking confirmation must be signed and returned by the client before an assignment.
Children under 16 years of age require a licence for any jobs or paid performances. It is the client’s responsibility to licence the children. Please note to put a licence in place takes a minimum of 5-21 working days, depending on the council involved.
If you would like My Kids Agency to apply for a Child Performance Licence on your behalf, there will be a fee of £30 per child, whether or not the child has been confirmed.
The parent/ legal guardian of the model agrees to My Kids Agency to act as the Child’s exclusive agent therefore the agency is permitted to sign release forms and contracts on behalf of the child and parent/ legal guardian. All forms must be sent to the agency before the assignment and not given to the parent/ legal guardian directly.
Any model that has been presented and introduced to a client or has done an assignment with them through My Kids Agency is then required that any further jobs must be booked through My Kids Agency. The client must not contact the parent unless given permission from the agency.
Any amendments to a booking must be discussed with My Kids Agency.
Booking fees entitle the right to use images from the date agreed with the agency only until the agreed amount of time, and only on the agreed platforms and territories. If you wish to extend the date or territories, then prior to the expiry date of the images original usage you must contact My Kids Agency to discuss this further.
My Kids Agency is granted the right to enquire about rates should another child from another agency be featured in the same role as a booked child from My Kids Agency.
All fees must be discussed and signed off by My Kids Agency before any bookings can be confirmed.
Booking fees differ depending on the work the model is required to do whether its Photographic, TV, Video, Film, Fitting Fee, Wardrobe, Voiceover, Fashion Show, Events, Theatre etc.
This will also be dependent on the usage and territories of the work permitted.
Fees are charged by the day or by the hour agreed at the time of booking by the Client and My Kids Agency. Equity contracts excluded.
Overtime applies after 8 hours. Charged at an additional £70 + 20% agency fee per hour which will then be added onto the final invoice.
Standard casting fee is charged at £20 + 20% agency fee per model unless discussed beforehand with My Kids Agency.
Its solely the clients responsibility to check with the agency before booking a model if they would like to know if any conflicting work has been done. If the model advertises a product they are able to then work for any other competitor unless an exclusion fee has been agreed by My Kids Agency.
For all bookings, apart from Equity Contract TV Commercials, an agency booking fee of 20% on all shoot and usage fees will apply. This will be applied to the final invoice along with the model fee’s. Any other agreed expenses and VAT where appropriate will also be added to the invoice.
Payments shall be made 30 days from the date of the invoice. Unless agreed at the time of booking, the person/company booking the model will be invoiced and solely responsible for payment. All fees are in respect of the right to use an image, and once agreed, are payable irrespective of such rights being exercised. We reserve the right to add an interest rate of 1% per month to overdue accounts without prejudice to our rights to recovery.
No usage of the model’s image is allowed to be published or released until payment is received in full unless this has been agreed beforehand with My Kids Agency in writing.
If a child is required to stay overnight for a shoot as travelling is over 2.5 hours or shooting consecutively on location and has early/late call times then the client is responsible for booking a hotel/accommodation for both the model and chaperone.
Travel costs should be reimbursed if the model is travelling outside of London (Within M25). If the child and chaperone use public transport then the full ticket prices will be covered by the client. If the chaperone is driving then petrol will be reimbursed at the standard rate of 0.45 pence per mile from home post code to the shoot location post code return. This will then be added to the final invoice.
When shooting for TV Commercial’s, all travel must be arranged by the production/agency company. Or they can choose to reimburse the chaperone if preferred. This will then be added to the final invoice.
The client is responsible for meals for the model, unless client requests parents to bring along pack lunch before the booking.
If a model is on an option/ pencil or a provisional booking and they have not been confirmed 24 hours prior to the proposed shoot date then the child will be cancelled.
If a confirmed booking is cancelled 24 hours before the shoot the full fee will be charged.
If a confirmed booking is cancelled 48 hours before the shoot then half the fee will be charged.
Saturdays and Sundays are excluded in accounting such cancellation periods.
If the child is cancelled with 48 hours noticed but re-booked immediately for another date then no extra fee will be charged to the client.
If the shoot date gets changed due to the weather then the normal fee will apply and the client will occur no extra charges unless they have failed to give sufficient notice to prevent the attendance of the model then the full fee will be charged.
If the shoot gets cancelled altogether (without re-booking the model) within 24 hours before the booking then – the full fee will be charged.
If the shoot gets cancelled altogether (without re-booking the model) 48 hours before the booking – then half the fee will be charged.
Saturdays and Sundays are excluded in accounting such cancellation periods.
All parties involved in the assignment, client, photographer or any other person must be GDPR compliant. This is not My Kids Agency’s responsibly or accountability to ensure all parties follow the Data Protection Act.
The client, photographer or any other person involved in any shoot/production is not entitled to use any of the images or work that the model has done for anything else other than the agreed usage.
Any images or footage taken on a casting are not allowed to be used or published on any platforms without the consent from the agency first.
The client is responsible for the model’s health & safety when the model is travelling, or providing services, in connection with the booking. The client will maintain adequate insurance cover to undertake its obligations to the model.
The agent is not responsible if the model fails to attend the booking because of ill health or any other reason. We aspire to always provide adequate and valuable services to our client, we cannot be held responsible for a model’s performance or conduct on a booking. The client is advised to insure against any losses that could occur due to this.
These terms and conditions for booking and all other matters connecting with the bookings are governed by English law and any dispute will be settled in accordance with that law by a court in England.
Any cause for complaint should be reported to the Agency as soon as it arises. Complaints cannot be considered in retrospect.
We retain the right to negotiate within the structure of these Terms and Conditions.
